I hope Vital Spark (a Betfair Forumite) will not mind, but I have written below my observations, views and opinions as to the reply he received from The Racing Post regarding the racing tipster Derek Thompson’s misleading and deceiving tipping adverts.
-----------------------------------
THE RACING POST LETTER
Dear Mr *********
"Thank you for your enquiry regarding Derek Thompson's tipping line.
All information carried within the adverts conform with all Advertising Standards guidelines for sports tipster service, as is with all tipster ads carried in the Racing Post".
The Racing Post has a dedicated team to ensure that all ad claims are factual and accurate. Mr Thompson's adverts reflect his recent performance prior to the advert and are accurate regarding the claims made.
Reflecting upon the true nature of horse racing, it is unrealistic to expect any individual or service to solely produce winners. When promoting any service, it is the positives that are focused upon and this is the approach taken. I reiterate that these ads are in conformity with the required advertising guidelines. Unfortunately we are not at liberty to send out Derek Thomson's records.
Tipster services carried within the Racing Post are reviewed on regular basis and steps are taken regarding any deemed to be under-performing.
I hope this answers your concerns.
Kind Regards…………… The Racing Post

“All information carried within the adverts conform with all Advertising Standards guidelines for sports tipster service, as is with all tipster ads carried in the Racing Post.”
PhonepayPlus sez:-………….PhonepayPlus guidelines require that….“No misleading claims are made in the promotion” .
The mere fact that the advert only contains winners and no losers is misleading to the reader. The advert misleads by omission. The omission of the tipster’s losers denies the reader the knowledge of the tipster’s losers. The tipster conceals the losers from the reader with intent to deceive and mislead him. Misleading by omission

“Mr. Thompson's adverts reflect his recent performance prior to the advert “
Derek Thompson had a 12-1 winner on the 4th December……… His results for December were so poor that he carried on gloating and boasting the 12-1 winner until January……….. 4 weeks after he tipped it!!
Is that what the Racing Post mean by “RECENT PERFORMANCE PRIOR TO HIS ADVERT??”…..A horse that he tipped 4 weeks ago?
So what comes next from Thompson? Will his adverts contain winners “prior” to 2008? ….. Perhaps The Racing Post would pass comment as to whether the word “prior” relates to a horse that won 4 weeks ago. But they won't. The opposite of the words prior is 'since' …. So how about Derek Thompson telling us how many losers he's had 'since’ he had the 12-1 winner on the 4th of December!
It’s all so very one sided isn't it?

“Reflecting upon the true nature of horse racing, it is unrealistic to expect any individual or service to solely produce winners”
“Reflecting upon the true nature of Horse racing!!!”
What the hell does that mean? Do old grannies, young people, new people, vulnerable people, unknowing people, unwary people and gullible people know what “the true nature of horse racing is”??? No they bl–dy well do not!!! They read and believe (why shouldn't they?) the stinking winner only adverts in a so called respectable newspaper and fall for the scam, day after day, week after week, year after year, decade after decade. These people are not capable of the privilege of “reflecting upon the true nature of horse racing”….. These people buy the Racing Post and see adverts that show winners only. The 090 tipster holds out his hand and takes their money. Money taken from innocent people by rogue racing tipsters.
It is the 090 rogue racing tipster that knows ”the true nature of horse racing” …….. AT THE EXPENCE OF THOSE THAT DO NOT!

“Reflecting upon the true nature of horse racing, it is unrealistic to expect any individual or service to solely produce winners
“it is unrealistic to expect any individual or service to solely produce winners”!!!!!!!
GOOD GOD!!!!!!!! Isn't that exactly what 090 misleading tipping adverts do? Thompson's adverts show “HIS SERVICE SOLELY PRODUCES WINNERS” UNREALISTIC OR NOT………, ACCORDING TO DEREK THOMPSON'S ADVERTS “HIS SERVICE SOLELY PRODUCE WINNERS!!!….If that is not the case then perhaps the Racing Post will show in which paper for the last 15 years he where he tipped a loser!!!
His adverts prove my point. In 20 years Derek Thomson has clearly shown every reader of his advert that he only tips winners.
And on the strength of that boast, people respond to his advert and pay him money. It is only AFTER he has taken their money that they realise they have been mislead by a dishonest and a not decent advert!!!! To late!! Thompson’s got their money and has banked it! Do they complain?…. No!….Why?…..Well it was only a fiver!!!………..That is the strength of the scam. People DO NOT COMPLAIN TO THE REGULATOR ABOUT JUST LOSING A FEW QUID ……..DO THEY?….. WOULD YOU if you were a newby to racing?

THE RACING POST SEZ:-
“When promoting any service, it is the positives that are focused upon and this is the approach taken.”
Oh I see!!!! Like only showing the winners and never the losers. So if a racing tipster is making a loss of £5000, The Racing Post are not interested as long as the tipster only focuses on his winners and carries on promoting them….As in ‘Winners only’…….But hang on a minute!….. If the service is £5000 down!!!! Doesn’t that matter?!!! .. It appears not!!…..All the Racing Post require is that the tipster remains “focused on promoting” his loss making service by only showing winners in his adverts. The fact that people who respond to the ‘winner only’ adverts and are massively out of pocket is secondary to the importance of focusing on adverts that only promote winners… (”THE POSATIVES”) The fact that the service is £5000 down is not important. The most important thing is to only show that the tipster can tip winners. The fact that the tipster is £5000 down is not to be disclosed to the reader,
I put it to the Racing Post that their “approach” to decent and honest people who put their trust in misleading tipping adverts contained and approved in their newspaper is immoral!……..As long as the tipster promotes a few winners and conceals hundreds of losers the Racing Post say
“When promoting any service, it is the positives that are focussed upon and this is the approach taken.”
AND THE NEGATIVES DO NOT GET FOCUSED?

THE RACING POST SEZ
“I reiterate that these ads are in conformity with the required advertising guidelines”
I believe that the regulators code of practice requires the advert not to be “misleading”. If that be the case, then is an advert that only shows winners and never the losers not misleading the reader by omission. Is not the omission of the losers and the promotion of the winners a deception to the reader?
I believe that the regulators code of practice requires adverts to be “honest”….If that be the case, then is not an advert that conceals the losers plus the appalling losses from the reader and only promotes the tipsters winners……a “dishonest” advert?
I believe that the regulators code of practice requires adverts to be “decent”. Are not adverts that trick, mislead, and deceive not indecent adverts?
I believe that the regulators code of practice requires adverts to be “moral”….Are not adverts that trick, mislead and deceive the reader, not immoral adverts?
And The Racing Post say their adverts conform with the required advertising guidelines!!!!

THE RACING POST SEZ.
“Unfortunately we are not at liberty to send out Derek Thomson's records.” How utterly convenient!
Perhaps they would be so kind as to inform us where they can be found

THE RACING POST SEZ;-.
“Tipster services carried within the Racing Post are reviewed on regular basis and steps are taken regarding any deemed to be under-performing”.
I say. If the Racing Post log into “Gerry atrics scam tipping blog” they will find all the evidence required as to Derek Thompson tipping ability “under performing” Masses and masses and masses of it!
I would ask the Racing Post that given the evidence contained within that blog (especially January’s) will they now be taking steps regarding the “underperforming” of Derek Thompson?….After all he is producing such huge NEGATIVE losses but is still “PROMOTING HIS POSATIVES” !!!!!!!
Perhaps the Racing Post would like to inform its readers as to what action they will take when they see that in November, Derek Thompson logged up the following appalling display of tipping rubbish
Thompson's winning days were
£9, £12, £24, £7, £6, £14, £8.
Thompson's losing days were:-
- £26, - £31, - £8, - £36, - £8, - £23, - £8, - £11, - £7, - £31, - £15, - £16, - £36, - £22, - £36, - £18, - £26, - £26, - £21, - £28, - £6, - £2
Will the Racing Post now be” taking steps as to Derek Thompson’s UNDERPERFORMING” ability to show a profit in any month of the year! But he does have the ability to take money from people that do not know of his DISABILITY AS A RACING TIPSTER….. DON'T THEY!!!!!!!!!!!!!!!
Think about that lot!!!!
